your opponent doesnt need to be in their draw phase to deck-out, because Morphing Jar says specifically to draw 5 Cards," so if their deck only has 4 cards when activated, they effectively deck-out. However, according to yugioh.wikia, damage calc...

There are detailed charts on how the battle phase (more specifically, the damage step where your area of interest is inquiring about). Read through them and you'll find your answer as to which comes first.
